
Introduction:
In the beginning, you need to know about what is intellectual property. The intellectual property is also known as the intangible property which belongs to the creation of the mind. These creations are maybe as inventions, literary and artistic work, designs & symbols, names, and images that may be used in the businesses or for the businesses. This creative work purely belongs to the creator and nobody can use that work without the permission of the creator. All the ownership rights owing by the creator and the Intellectual Property Organization (IPO) protect the rights of the creator. Intellectual Property Organization of Pakistan is the autonomous body which has the administrative control of the Cabinet Division for integrated and efficient intellectual property management in the Country. The IPO has the trademark registry, copyright office, and patent, and design office. It not only protects the rights of the creators but also creates awareness about IP rights through seminars and literary materials. When you curious about the intellectual property you need to know the concept of all that.
The mark may be carried about the nature of the business as that can be used for trade and service. The mark that will use for trade is called trademark and the mark is used for the service called the service mark. The mark may contain words, phrases, symbols, and/or design that identifies and distinguishes the source of the goods of one party from those of others. This trademark or service mark may be registered by the IPO through its sub-body the trademark registry. It has the new role of creating awareness about the importance of intellectual property with the promulgation of the Trademarks Ordinance, 2001.
The patent is an authority or permission by the government that conferring the right for a specified period to someone regarding making, using, selling, and inventions and to prevent the third-party intervention. The IPO has its design and patent office that also grants the rights for an invention to make, use and sell the invention for a limited period of 20 years and exclude the others from making, using, or selling the invention. The patent rights cannot be claimed until that cannot be allowed by the department under the Patents Ordinance, 2000. The following inventions may be patentable under the law in the country;
- The invention of Process and Product
- The invention of novel or new
- The steps should be inventive
- It is capable of industrial application
The design may be simply defined that a pattern, shapes, plan, and drawing which may be for building, garments, or any other object before to make. The IPO has its design and patent office that allow the applicant to hold the rights for ten years. The industrial design may be ornamental or aesthetic of the article. The design may consist of three-dimensional features, such as the shape or surface of an article, or two-dimensional features, such as patterns, lines or color. The design may register under the Registered Design Ordinance, 2000, by IPO’s sub-body design and patent office.
Copy right assigns the legal rights to the creator for the specific period and away from the other intervention under the copyright ordinance, 1962. The following type of work may be claimed under the law;
- Literary work
- Artistic work
- Cinematographic work
- Recorded work
Conclusion:
The IPO regulates under the IPO-Pakistan Act, 2012 which provides complete protection about the rights of the creator. It is the objective of the department to promote and protect Intellectual Property Rights. It is improving public awareness, service delivery, and enhanced enforcement coordinating for achieving the goal. The applicant needs to follow and learn the rules while when you are curious about your intellectual property.
