Copyright provides the legal ownership to the creator of the work and protects the work from duplication and replication. Copyright is the fourth pillar of intellectual property, and the Intellectual Property Organization deals with it as a trademark, design, patent. In this article, we will learn how to register the copyright in Pakistan but before all that, we need to know which kind of work may get copyright registration.

The work which needs to Register the copyright:

  • Creative work in the form of Literary, Musical work, and Dramatic work that is available for copyright, it also includes computer programming/software development and data compilation related work.
  • Artistic kinds of work and the work related to Cinematographic such as VCD, DVD, etc., and Audio Recording work as audio cassette and CDs.

How to Register the Copyright in Pakistan With Detail Procedure: –

The complete procedure of the copyright registration along with documentation and fee structure as below, we will discuss all the kinds one by one.

Artistic Work:

  1. Application form in the prescribed Form-II.
  2. Artistic work.

Note: Three copies of both.

  1. Advertisement in the newspaper.

Note: Two copies of the newspaper.

  1. NOC/ Affidavit for transfer for copyright from the artist.
  2. Undertaking/Affidavit by the artist as the applicant.
  3. Trademark Number if the work is using as a trademark.
  4. Power of attorney (vakalatnama), if the application filing through the attorney.
  5. Pay order/bank draft of Rs. 2000/- for artistic work.
  6. Pay order/bank draft of Rs. 6000/-, if the work is using as a trademark.

Literary work:

  1. Application form-II.

Note: Three copies of the form.

  1. Copies of the work.

Note: Two copies of the literary work.

  1. NOC/ Affidavit for transfer for copyright from the owner or writer.
  2. Undertaking/Affidavit by the artist as the applicant.
  3. Pay order/bank draft of Rs. 2000/- for the literary work only.
  4. Pay order/bank draft of Rs. 5000/- for computer programs or software.

Record work:

  1. Application form-II.

Note: Three copies of the form.

  1. Copies of the work.

Note: Two copies of the audio work such as VCD/DVD/CD/USB.

  1. NOC/ Affidavit from all the contributors and performers.
  2. Undertaking/Affidavit by the artist as the applicant.
  3. Pay order/bank draft of Rs. 2000/- for music, sounds, songs, etc.
  4. Pay order/bank draft of Rs. 2000/- for musical video.

Note: This fee is applicable for each song or track.

            Cinematographic work:

  1. Application form-II.

Note: Three copies of the form.

  1. Copies of the work.

Note: Two copies of the cinematographic work such as video VCD/DVD/CD/USB.

  1. NOC/ Affidavit from all the contributors and performers.
  2. Undertaking/Affidavit by the artist as the applicant.
  3. Pay order/bank draft of Rs. 10,000/- for the movies, drama work, feature film, animated film, video game, etc.

Process of the Registration of the Copyright: –

  1. The application form should be fill up in the above-mentioned prescribed format and complete the file with the required documents to submit before the department. The department will issue the computerized acknowledgment receipt with file number at the reception of any IPO office.
  2. The department examines the filed application and opposes it if there is any issue. The applicant must remove the opposition and satisfy the department.
  3. After the satisfaction of the department, the department may issue the certificate.

All the forms may be downloaded from the website of the IPO.

The pay order/demand draft will be on the name of “Director General, IPO – Pakistan”.
